Les présentes conditions sont rédigées en français, langue de référence, qui fait foi. Elles complètent les Conditions Générales de Vente.
Les présentes conditions générales d'utilisation (les « CGU ») encadrent l'accès au service DawnFall et son utilisation : le site dawnfall.fr, le launcher DawnFall et les serveurs de jeu (ensemble, le « Service »). Elles s'appliquent à tout utilisateur (l'« Utilisateur »), qu'il effectue ou non des achats.
L'utilisation du Service implique l'acceptation sans réserve des présentes CGU. La vente de biens numériques est régie par les Conditions Générales de Vente (CGV), distinctes des présentes.
L'éditeur du Service est Théo CARTRON, entrepreneur individuel exerçant sous le nom commercial DawnFall Studio (voir l'article 2 des CGV pour l'identification complète et l'hébergeur). Contact : contact@dawnfall.fr.
L'accès au Service nécessite la création d'un compte DawnFall.
Sur le Service, il est interdit :
DawnFall garantit à ses joueurs une expérience sans triche et sans pay-to-win. À cette fin :
Constitue une triche l'utilisation de tout moyen non autorisé procurant un avantage en jeu ou altérant le fonctionnement normal du jeu, notamment : logiciels ou clients de triche, mods non approuvés par DawnFall, éditeurs de mémoire, injecteurs, manipulation des échanges réseau, automatisation ou robots, ainsi que toute tentative de contourner le dispositif anti-triche.
Le launcher DawnFall constitue le dispositif anti-triche principal : seuls les mods figurant dans le manifeste signé par DawnFall sont autorisés, et le launcher en vérifie l'intégrité avant et pendant la partie. L'Utilisateur reconnaît et accepte que le launcher effectue ces contrôles de sécurité (vérification des mods chargés, détection de logiciels de triche connus), sans lesquels l'accès aux serveurs est refusé.
La triche caractérisée - au sens notamment de l'article 11 des CGV - s'entend de l'usage établi de l'un de ces moyens. Elle expose l'Utilisateur aux sanctions de l'article 6.
L'Utilisateur peut publier certains contenus : fichier de skin téléversé, messages de chat, nom d'utilisateur.
En cas de manquement aux présentes CGU, DawnFall peut prononcer, de manière proportionnée au manquement, une sanction. Un avertissement ou une restriction temporaire (par exemple la privation du chat) peuvent sanctionner tout manquement ; la suspension temporaire et l'exclusion définitive du compte sont réservées aux manquements graves ou répétés, conformément à l'article 11 des CGV.
En cas de contenu susceptible de constituer une infraction pénale, notamment lorsqu'un mineur est concerné, DawnFall conserve les éléments utiles et procède aux signalements requis auprès des autorités compétentes.
Signalement. Tout Utilisateur, ainsi que toute autre personne ou entité, peut signaler un contenu ou un comportement qu'il estime illicite ou contraire aux présentes CGU. Le signalement s'effectue par voie électronique, sur notre serveur Discord ou en écrivant à contact@dawnfall.fr.
Pour permettre un examen sérieux, le signalement comporte :
Traitement. Lorsque le signalement comporte des coordonnées électroniques, DawnFall en accuse réception sans délai injustifié. Chaque signalement est examiné par une personne habilitée, de manière diligente, non arbitraire et objective. À ce jour, DawnFall n'a recours à aucun moyen automatisé pour traiter les signalements ni pour décider des suites à leur donner. L'auteur du signalement est informé de la décision prise ainsi que des voies de recours mentionnées ci-dessous.
Décision motivée. Lorsque DawnFall, au motif qu'un contenu est illicite ou contraire aux présentes CGU, restreint la visibilité d'un contenu (retrait, blocage d'accès, rétrogradation), suspend ou résilie en tout ou partie la fourniture du Service, ou suspend ou résilie le compte d'un Utilisateur, la personne concernée reçoit une décision motivée indiquant :
Voies de recours. Toute décision peut être contestée en écrivant à contact@dawnfall.fr. L'Utilisateur consommateur peut en outre recourir gratuitement au médiateur de la consommation (article 14 des CGV) et saisir les juridictions compétentes.
Les présentes stipulations mettent en œuvre les articles 16 et 17 du règlement (UE) 2022/2065 relatif à un marché unique des services numériques.
Conformément aux articles 11 et 12 du règlement (UE) 2022/2065, DawnFall désigne les points de contact suivants :
DawnFall étant établi en France, la désignation d'un représentant légal au sens de l'article 13 du même règlement n'est pas requise.
À l'exception des contenus publiés par les Utilisateurs (régis par l'article 5), l'ensemble des éléments du Service - le jeu, les cosmétiques, les visuels, les marques, le launcher et le site - sont la propriété de DawnFall ou de ses concédants, et sont protégés par le droit de la propriété intellectuelle.
L'Utilisateur bénéficie d'un droit d'usage personnel, non exclusif et non transférable de ces éléments, dans le seul cadre du Service. Sont notamment interdits : la reproduction, la distribution, la vente, la décompilation ou l'ingénierie inverse de ces éléments, ainsi que toute exploitation commerciale.
Les Éclats de Lotus et les cosmétiques confèrent un droit d'usage au sein du Service, et non un droit de propriété ; ils ne sont ni transférables ni convertibles (voir l'article 3 des CGV).
DawnFall concède à l'Utilisateur le droit de télécharger et d'utiliser le launcher dans le seul but d'accéder au Service. Il est interdit de le modifier, de le décompiler ou de le redistribuer.
Le launcher réalise des contrôles de sécurité nécessaires à l'intégrité du jeu (voir l'article 4). Ces contrôles ne collectent aucun identifiant matériel ; leur nature et les données traitées sont décrites dans la Politique de confidentialité.
DawnFall est tenu à une obligation de moyens quant à la disponibilité du Service, qui peut être interrompu pour maintenance ou pour une cause indépendante de sa volonté. DawnFall peut faire évoluer le Service (modes de jeu, fonctionnalités, contenus). En cas d'arrêt définitif du Service, les conditions de l'article 11 des CGV s'appliquent (préavis et remboursement au prorata des abonnements en cours).
Le traitement des données personnelles de l'Utilisateur est décrit dans la Politique de confidentialité, accessible sur dawnfall.fr, conforme au Règlement (UE) 2016/679 (RGPD).
L'accès au Service par un mineur est soumis aux conditions de l'article 10 des CGV et de la Politique de confidentialité (âge du consentement numérique fixé à 15 ans en France, autorisation du représentant légal en dessous).
La responsabilité de DawnFall ne saurait être engagée en cas de force majeure ou de fait imputable à l'Utilisateur. DawnFall ne contrôle pas les serveurs partenaires et ne répond pas de leur fonctionnement. La présente clause ne saurait exclure ou limiter les garanties légales applicables aux biens numériques achetés (voir l'article 8 des CGV).
DawnFall peut modifier les présentes CGU. En cas de modification substantielle, l'Utilisateur en est informé avant son entrée en vigueur, par courriel ou via son compte. La poursuite de l'utilisation du Service vaut acceptation des CGU modifiées.
Les présentes CGU sont soumises au droit français. Ce choix ne prive pas l'Utilisateur consommateur résidant dans un autre État membre de l'Union européenne de la protection que lui assurent les dispositions impératives de la loi de son pays de résidence habituelle. Pour toute réclamation ou recours à la médiation de la consommation, l'article 14 des CGV s'applique (médiateur CM2C).

These terms of use (the "Terms") govern access to and use of the DawnFall service: the dawnfall.fr website, the DawnFall launcher and the game servers (together, the "Service"). They apply to every user (the "User"), whether or not they make purchases.
Using the Service implies unreserved acceptance of these Terms. The sale of digital goods is governed by the Terms of Sale, which are separate from these Terms.
The Service is published by Théo CARTRON, a sole trader operating under the trade name DawnFall Studio (see article 2 of the Terms of Sale for full identification and the host). Contact: contact@dawnfall.fr.
Access to the Service requires the creation of a DawnFall account.
On the Service, it is forbidden:
DawnFall guarantees its players a cheat-free and pay-to-win-free experience. To that end:
Cheating means the use of any unauthorised means that provides an in-game advantage or alters the normal operation of the game, in particular: cheat software or clients, mods not approved by DawnFall, memory editors, injectors, tampering with network traffic, automation or bots, as well as any attempt to circumvent the anti-cheat system.
The DawnFall launcher is the main anti-cheat system: only the mods listed in the manifest signed by DawnFall are allowed, and the launcher verifies their integrity before and during play. The User acknowledges and accepts that the launcher performs these security checks (verification of loaded mods, detection of known cheat software), without which access to the servers is refused.
Established cheating - within the meaning of, among others, article 11 of the Terms of Sale - means the proven use of any of these means. It exposes the User to the sanctions of article 6.
The User may publish certain content: uploaded skin file, chat messages, username.
In the event of a breach of these Terms, DawnFall may impose, proportionately to the breach, a sanction. A warning or a temporary restriction (for example being cut off from the chat) may sanction any breach; temporary suspension and permanent exclusion of the account are reserved for serious or repeated breaches, in accordance with article 11 of the Terms of Sale.
Where content may constitute a criminal offence, in particular where a minor is concerned, DawnFall keeps the relevant material and makes the reports required to the competent authorities.
Reporting. Any User, as well as any other person or entity, may report content or behaviour they consider unlawful or contrary to these Terms. Reports are submitted electronically, on our Discord server or by writing to contact@dawnfall.fr.
To allow for a serious review, a report includes:
Handling. Where a report includes electronic contact details, DawnFall acknowledges receipt without undue delay. Each report is reviewed by an authorised person, in a diligent, non-arbitrary and objective manner. As of today, DawnFall does not rely on any automated means to process reports or decide on the follow-up given to them. The person who submitted the report is informed of the decision taken as well as the means of redress mentioned below.
Statement of reasons. Where DawnFall, on the ground that content is unlawful or contrary to these Terms, restricts the visibility of content (removal, disabling of access, demotion), suspends or terminates in whole or in part the provision of the Service, or suspends or terminates a User's account, the person concerned receives a statement of reasons indicating:
Means of redress. Any decision may be challenged by writing to contact@dawnfall.fr. Consumer Users may also make free use of the consumer mediation body (article 14 of the Terms of Sale) and bring proceedings before the competent courts.
These provisions implement articles 16 and 17 of Regulation (EU) 2022/2065 on a Single Market For Digital Services.
In accordance with articles 11 and 12 of Regulation (EU) 2022/2065, DawnFall designates the following points of contact:
As DawnFall is established in France, designating a legal representative under article 13 of the same Regulation is not required.
Except for content published by Users (governed by article 5), all elements of the Service - the game, the cosmetics, the visuals, the trademarks, the launcher and the website - are the property of DawnFall or its licensors, and are protected by intellectual property law.
The User has a personal, non-exclusive and non-transferable right of use of these elements, solely within the Service. The following are in particular forbidden: reproduction, distribution, sale, decompilation or reverse engineering of these elements, as well as any commercial exploitation.
Lotus Shards and cosmetics grant a right of use within the Service, not a right of ownership; they are neither transferable nor convertible (see article 3 of the Terms of Sale).
DawnFall grants the User the right to download and use the launcher for the sole purpose of accessing the Service. It is forbidden to modify, decompile or redistribute it.
The launcher performs the security checks necessary for the integrity of the game (see article 4). These checks collect no hardware identifier; their nature and the data processed are described in the Privacy Policy.
DawnFall is bound by a best-efforts obligation as to the availability of the Service, which may be interrupted for maintenance or for a cause beyond its control. DawnFall may change the Service (game modes, features, content). In the event of a permanent shutdown of the Service, the conditions of article 11 of the Terms of Sale apply (notice period and pro-rata refund of ongoing subscriptions).
The processing of the User's personal data is described in the Privacy Policy, available on dawnfall.fr and compliant with Regulation (EU) 2016/679 (GDPR).
Access to the Service by a minor is subject to the conditions of article 10 of the Terms of Sale and of the Privacy Policy (digital-consent age set at 15 in France, with the legal guardian's authorisation required below that age).
DawnFall cannot be held liable in the event of force majeure or an act attributable to the User. DawnFall does not control partner servers and is not responsible for their operation. This clause cannot exclude or limit the legal warranties applicable to purchased digital goods (see article 8 of the Terms of Sale).
DawnFall may amend these Terms. In the event of a substantial change, the User is informed before it takes effect, by email or via their account. Continued use of the Service constitutes acceptance of the amended Terms.
These Terms are governed by French law. This choice does not deprive a consumer User residing in another European Union Member State of the protection afforded by the mandatory provisions of the law of their country of habitual residence. For any complaint or recourse to consumer mediation, article 14 of the Terms of Sale applies (CM2C mediator).
